Density Bonus / fee-in-lieu

Below is my attempt to capture our CodeNext discussion yesterday morning regarding a request to staff to provide potential approaches to the approval process for fee-in-lieu requests for the density bonus program.

Here's the proposed language for this request to staff. Please add, change, or make any comments on this language.

To NHCD staff:

Please provide recommendations on the Density Bonus Program regarding:
(1) criteria to include in the land development code to be used to decide when fee-in-lieu or off-site production is an appropriate alternative to on-site production of bonus units, and
(2) the appropriate authority(ies) for evaluating and approving fee-in-lieu or off-site production requests.

In making these recommendations, please consider the following options:
(1) Planning Commission approval for some level or type of requests for fee-in-lieu with criteria or categories for which requests would go to the Planning Commission.
(2) Council approval for some level or types of requests for fee-in-lieu with criteria or categories for which requests would go to Council.
(3) All requests to be reviewed by the proposed group of experts ("Review Group") which would make a recommendation to the Planning Commission and/or the Council depending on the level or type of request.
