Resolution on Code Compliance for court fees when CC in err

WHEREAS, the City of Austin’s Code Compliance Department personnel should concern themselves with whether or not property owners are sufficiently maintaining their properties in the City for the benefit of the community as a whole; and

WHEREAS, the Code Compliance Department should be consistent in its definition of what is out-of-compliance with the Austin City Code regardless of which employee of the Department is doing the inspection; and

WHEREAS, some disputes between the Code Compliance Department and property owners have escalated to the point of litigation in Municipal Court; now, therefore, be it

RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, that the City Manager be instructed to take all necessary actions to ensure that any property owner who prevails in Municipal Court in a dispute with the Code Compliance Department is entitled to reimbursement from the City for reasonable attorney fees and that such amount be deducted from the budget of the Code Compliance Department.
